1. Introduction
The Promotion of Access to Information Act gives everyone the right to request access to records held by a private body, where those records are needed to exercise or protect a right. This manual explains what records Innovation by Design holds, how to ask for them, what it may cost, and how we handle personal information.
Innovation by Design is a digital strategy, design, development and marketing agency based in Johannesburg, serving South African businesses and schools.

5. Records we keep in terms of other laws
Where they apply to us, we keep records in accordance with laws including:
- Companies Act 71 of 2008
- Income Tax Act 58 of 1962
- Tax Administration Act 28 of 2011
- Consumer Protection Act 68 of 2008

- Promotion of Access to Information Act 2 of 2000
- Copyright Act 98 of 1978
This list is not complete. Records held in terms of a law are available as that law allows.
6. Subjects and categories of records we hold
| Subject | Categories of records |
|---|---|
| Company records | Incorporation documents, Memorandum of Incorporation, register of directors and shareholders, resolutions and statutory returns |
| Financial and tax records | Accounting records, invoices and quotes, bank records, financial statements and tax returns |
| Client records | Proposals, quotes, agreements, correspondence, project briefs, project files and deliverables, and access details for client platforms we manage |
| Contractor and supplier records | Agreements with freelance specialists and suppliers, invoices and correspondence |
| Marketing and enquiry records | Website and advertising enquiries, call bookings, a lead log, and email and WhatsApp correspondence |
| Website and IT records | Website content, analytics and advertising data, website security logs and backups |
Listing a category here does not mean a request for those records will be granted. Every request is considered in terms of PAIA, including its grounds for refusal.
7. How we process personal information
Purpose
We process personal information to respond to enquiries, prepare proposals, deliver and manage client work, work with our contractors, invoice and keep financial records, market our services where permitted, improve our website, and meet our legal obligations.
Categories of people and information
| People | Information we may hold |
|---|---|
| Clients and their staff | Names, job titles, contact details, business details, billing details, correspondence and project information |
| Prospective clients and website visitors | Names, contact details, enquiry details, booking details, and website usage and device data collected through cookies and analytics where consent is given |
| Contractors and suppliers | Names, contact and business details, banking details for payment, agreements and correspondence |
Who we may share it with
- Contractors and specialists who help deliver client work, bound by confidentiality
- Service providers we use to run our business, including email and productivity, website hosting, call booking, analytics, advertising and messaging platforms
- Our accountants, bookkeepers, auditors and legal advisers
- Government bodies such as the South African Revenue Service, where the law requires it
Information sent outside South Africa
Some of our service providers, including providers of email, cloud storage, analytics, advertising and messaging services, store or process information outside South Africa. We use reputable providers and only share personal information outside South Africa in line with section 72 of POPIA.
How we protect it
We use reasonable technical and organisational measures, including encrypted connections (HTTPS) on our website, access controls and strong authentication on our accounts, limiting access to people who need it, keeping software up to date, regular backups, and confidentiality undertakings from contractors.
For more detail, read our privacy policy.
8. How to request access to a record
- Complete the request form (Form 2 of the PAIA Regulations), available on the Information Regulator’s website. You may also ask us for a copy.
- Give enough detail for us to identify the record, say how you want access (for example a copy by email), and explain which right you are trying to exercise or protect.
- If you are asking on behalf of someone else, include proof of your authority.
- Send the completed form to the Information Officer at info@innovationbydesign.co.za, or deliver it to our address.
- Pay the request fee, if one applies. We will tell you if it does.
We will tell you our decision within 30 days of receiving a complete request. In limited circumstances allowed by PAIA, we may extend this once by up to 30 days, and we will tell you why.
If you want to see or correct your own personal information, you can also simply contact us at info@innovationbydesign.co.za. You do not need to use the PAIA process for that.
9. Fees
PAIA allows a private body to charge a request fee and an access fee, in the amounts prescribed in the PAIA Regulations. The current fee schedule is available on the Information Regulator’s website. A request fee does not apply when you ask for your own personal information. If an access fee applies, we will tell you the amount before you pay, and you may be asked for a deposit where the search will take a long time.
10. Grounds for refusal
PAIA sets out grounds on which access must or may be refused. These include protecting the privacy of other people, the commercial information of third parties, confidential information, the safety of people and property, records privileged from production in legal proceedings, and our own commercial information. If we refuse a request, we will explain why.
11. Remedies
We do not have an internal appeal procedure. If you are not satisfied with our decision, you may lodge a complaint with the Information Regulator, or apply to a court, within 180 days of being told of the decision.
12. Availability and updates
This manual is available on our website and may be inspected free of charge at our address during normal business hours. We will provide a copy to the Information Regulator on request. We review this manual regularly and will update it when our details or practices change.
